This is a legal agreement between yourself and Riverside LGBTQ+ Inc, and by using this website or participating in any activity related to this organization, you agree to these terms without the right to revoke the agreement.
Volunteer Waiver & Release
In return for being allowed to participate in volunteer activities and all related activities, including any activities incidental to such participation (“Volunteer Activities”), the Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, or “my”) releases and agrees not to sue the Riverside LGBTQ+ Inc, or its officers, directors, employees, sub-contractors, sponsors, agents and affiliates (“the Foundation”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities
wherever, whenever, or however the same may occur.
I understand and agree that the Foundation are not responsible for any injury or property damage arising out of the Volunteer Activities, even if caused by their ordinary negligence or otherwise.
I understand that participation in the Volunteer Activities involves certain risks, including, but not limited to, serious injury and death. I am voluntarily participating in the Volunteer Activities with knowledge of the danger involved and I agree to accept all risks of participation.
I also agree to indemnify and hold harmless the organization for all claims arising out of my participation in the Volunteer Activities.
I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of California in which the Volunteer Activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
I also acknowledge that Riverside LGBTQ+ Inc. have not arranged and do not carry any insurance of any kind for my benefit or that of Volunteer (if Volunteer is under 18), my parents, guardians, trustees, heirs, executors, administrators, successors and assigns. I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in Volunteer Activities.
I further acknowledge that my participation may result in my likeness being recorded by photograph, video, or audio and that I grant the Foundation the right to use these images or recordings for promotional purposes such as but not limited to social media, print, and promotional video.
I also understand that this document is a contract which grants certain rights to and eliminates the liability of the Foundation.
Shopping & Ticket Sales
We offer merchandise and tickets for sale on our website. All transactions are governed by these terms & conditions and by placing an order on our website, you agree to these terms.
Refunds and exchanges: Physical merchandise that arrives defective or damaged may be exchanged for the same item only, when you contact us by email at gro.E1653209639Iedir1653209639Pedis1653209639reviR1653209639@olle1653209639H1653209639 within 3 days of receiving the shipment. We cannot be responsible for damage during shipping however we will do our best to assist you in filing a claim with the shipping provider. Due to the charitable nature of our work we do not allow refunds for orders, only exchanges for defective merchandise. All TICKET sales are final, and no refunds will be given unless the event is canceled by us. If you lose or damage your ticket, please contact us by email at gro.E1653209639Iedir1653209639Pedis1653209639reviR1653209639@olle1653209639H1653209639 and we will do our best to resend your tickets to you, otherwise we are not responsible for lost, stolen or damaged tickets. When your ticket is scanned at the event it becomes void and cannot be used for entry again. Unless you are provided a wristband at the door of the event, no return privileges are available and if you leave the event you may not return without a valid, unscanned ticket. Tickets include all taxes and fees.
We hold a lot of public events. Although the situation surrounding the world pandemic has eased there is still risk of contracting the virus.
WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to be transmitted by spread person-to-person contact and/or by droplets or aerosols in the air, and possibly contact with contaminated surfaces and objects. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. Riverside LGBTQ+ Pride Inc, the Board of Directors, and the City cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while attending its event and/or entering onto premises where events are held. It is not possible to prevent against the presence of the disease. Therefore, if you choose to attend an event organized by Riverside LGBTQ+ Pride Inc and enter onto premises where its events are held, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. ASSUMPTION OF RISK: I understand the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself in order to attend a Riverside LGBTQ+ Pride Inc event and enter the premises. The event is of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to attend in person.
NOTICE OF FILMING AND PHOTOGRAPHY
When you enter a Riverside LGBTQ+ Pride Inc or program, you enter an area where photography, audio, and video recording may occur. By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by Riverside LGBTQ+ Pride Inc and its affiliates and representatives. Images, photos and/or videos may be used to promote similar Riverside LGBTQ+ Pride Inc events in the future, highlight the event and exhibit the capabilities of Riverside LGBTQ+ Pride Inc . You release Riverside LGBTQ+ Pride Inc , its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by Riverside LGBTQ+ Pride Inc or the person or entity designated to do so by Riverside LGBTQ+ Pride Inc . You have been fully informed of your consent, waiver of liability, and release before entering the event.
This policy and agreement shall be included in any contract or partnership documents that Riverside LGBTQ+ Pride Inc may participate in and we agree not to enter knowingly into an agreement with another party who does not uphold these values.
Riverside LGBTQ+ Pride Inc. does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. These activities include, but are not limited to, hiring and firing of staff, selection of volunteers and vendors, and provision of services. We are committed to providing an inclusive and welcoming environment for all members of our staff, clients, volunteers, subcontractors, vendors, and clients.
All volunteers, employees, associates, contractors and other affiliates agree without exception to not discriminate against any other based on these same values. All volunteers, partners, associates and affiliates agree to act, at all times, with respect and compassion for those around them.
