Food Vendor Agreement(Required) Riverside’s Inland Empire Pride Festival 2025 Food Vendor Agreement

This is your Food Vendor application (the “Application”) to be a Food Vendor (the “Food Vendor”) at Riverside's Inland Empire Pride Festival 2025 (the “Event”) at White Park in downtown Riverside (the “Venue”). This Application does not guarantee space in the Event but expresses your interest in participating in the event. Riverside LGBTQ+ Pride Inc. (the “Organizer”) must comply with exclusivity, as well as state, county and local regulations and more. We reserve the right to deny any Application for any reason. If any payment has been paid before your Application is denied, the Organizer will refund 100% of the payment.
The Food Vendor understands and agrees to the following terms of participation:
OPERATION: The Food Vendor must remain open for the entirety of the festival hours, and should load in or close and load out according to the designated times set by the Organizer. The Food Vendor must check out at the Food Vendor Concierge prior to departure. Failure to do so might result in a $100 penalty to be charged after the event. Early load out exceptions can be made, The Food Vendor may notify the Organizer ahead of the event to receive exemption. Food Vendor CHOICES: Food Vendor packages offered are listed on https://riverside.lgbt/festival-food-vendor
DISCRIMINATION: The Food Vendor may not and will not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. These activities include, but are not limited to, hiring and firing of staff, selection of volunteers and vendors, and provision of services. We are committed to providing an inclusive and welcoming environment for everyone involved, and require all of our affiliates to do the same. Failure to comply with is policy will result in immediate termination of this agreement without refund and be banned from future Organizer events.
EQUIPMENT: The Food Vendor will not be provided table, tablecloth, chairs unless explicitly purchased through the Application. Electricity is not available. Food Vendor must notify Organizer of use of open or exposed flames, heating and cooking equipment, LP Gas, generators inside and outside of the tent.
BOOTH SPACE: Booth space is up to 10 feet by 20 feet in size. The Food Vendor must be contained within their allotted space. Nothing is allowed in the aisles. No shelves or displays taller than 8 feet allowed. If you have a larger, secured display, exceptions can be made, subject to fire code adherence and inspection by a fire marshal. Hanging or securing any items directly on the walls or any fixtures of the Venue must be done with painters tape. The Food Vendor will be held liable if there are any damages done to the Venue.
PERMITS AND LICENSING: It is the responsibility of Food Vendor to obtain any and all permits for doing business in City of Riverside and Riverside County, including county health permit, with the exception of City of Riverside Business License if Food Vendor has elected to procure one through the Application. The Organizer is not liable and will not provide refunds for any Food Vendor who is forced to close due to lack of permits and documentation.
FIRE AND HEALTH CODE ADHERENCE: Food Vendor will be subjected to City of Riverside fire inspection in adherence to California Fire Code and California Building Code for outdoor gatherings and events tents and membrane structures (reference can be found at https://riverside.lgbt/rfd-outdoor-regulations), and health inspection from the County of Riverside health inspector. Food Vendor must adhere to the Riverside County Department of Environmental Health’s Temporary Food Facility Operator’s Guide (can be found at https://riverside.lgbt/rivco-tff-ops-guide), and be ready for inspection at least one hour prior to festival opening time. Failure to do so and passing inspections by relevant government officials will result in ejection from the Event with no refund.
FIRE EXTINGUISHERS: If Food Vendor will be operating heating or cooking equipment, Food Vendor must bring at least one (1) fire extinguisher with a rating of not less than 2A:10BC.
OPEN OR EXPOSED FLAMES: Open Flame or other devices emitting flame, fire, or heat or any flammable or combustible liquid, gas, charcoal or other cooking device or any other unapproved devices will not be permitted inside or located within 20 feet of the tent or membrane structures while open to the public unless approved by the fire code official. (CFC 3107.4)
HEATING AND COOKING EQUIPMENT: Cooking and heating equipment will be vented to the outside air by approved means. Vents and flues will be a minimum of 12 inches from sides and tops of tents and temporary membrane structures. Cooking and heating equipment will not be located within 10 feet of an exit or combustible material. Tents where cooking is performed will be separated from membrane structures, other tents by a minimum of 20 feet. Outdoor cooking that produces sparks or grease-laden vapors will be at least 20 feet from tents and membrane structures. (CFC 3107.12)
LP GAS: LP-gas containers will be located on the outside, a minimum of 10 feet for containers 500 gallons or less and 25 feet for containers more than 500 gallons from tents and temporary membrane structures. Containers will be protected to prevent tampering, damage, or tipping over. If the area or location does not permit the required distance, please check with the Fire Inspector for an approved location. (CFC 3107.13, 6104.3)
FLAMMABLE & COMBUSTIBLE LIQUIDS: Flammable-liquid-fueled equipment shall not be used in tents and temporary membrane structures. Flammable and combustible liquids shall be stored outside in an approved manner not less than 50 feet from a tent or membrane structure. Generators shall not be installed less than 10 feet from combustible materials. (CFC 3106.6.2, 3107.14 – 3107.14.2)
SEPARATION OF GENERATORS: Generators and other internal combustion power sources shall be separated from tents and temporary membrane structures by a minimum of 20 feet and be isolated from contact with the public by fencing, enclosure, or other approved means. (CFC 3107.16)
MUSIC AND AUDIO: No music, video, or other sound may be amplified in a manner which disturbs surrounding Food Vendors or exhibits. The Organizer, in its sole discretion, reserves the right to monitor or prohibit the use of any equipment or machinery that is detracting from other Food Vendors or exhibits.
SMOKING of any substance or use of tobacco products is strictly prohibited, including vape pens, electronic cigarettes, or any other vaping device. This includes marijuana.
DISPOSAL OF WASTE AND CLEANUP: The Food Vendor must clean up all items brought into the Venue, and “leave no trace” after the Event.
NO MATURE CONTENT: No materials on display, distributed, or for sale may be mature-rated. The Organizer reserves rights to remove any materials deemed inappropriate on the festival floor.
INDEMNIFICATION: The Organizer, the Venue, the event’s Food Vendors, any of their officers, agents, volunteers, employees, independent contractors or other representatives will not be held liable for, and they are expressly released from, liability for any damage, loss, harm or injury to the person or property of Food Vendor or any of its officers, agents, volunteers, employees, independent contractors or other representatives, resulting from theft, fire, water, accident or any other cause. Food Vendor will indemnify, defend and hold harmless the Organizer, the Venue, the event’s Food Vendors, and any of their officers, agents, volunteers, employees, independent contractors or other representatives:
a. From and against any and all claims arising from any acts, failures to act, or negligence of Food Vendor or any of its officers, agents, volunteers, employees, independent contractors or other representatives;
b. From and against any and all claims arising from the breach of, or default in the performance of any obligation on Food Vendor’s part to be performed under, these terms and conditions; and
c. From and against all costs, attorney’s fees, expenses, and liabilities incurred in the defense of any such claim or any action.
PAYMENT: Payment is due at the time of the Application.
EVENT CANCELATION & REFUNDS: If the event is canceled due to weather or other factors beyond the Organizer control, including but not limited to, natural disasters, public health concerns, or credible threats to the safety of attendees, the Food Vendor acknowledges that Food Vendors are non-refundable. The Organizer will exercise reasonable effort to postpone and reschedule the event instead of canceling. In the case that the Event is not rescheduled, Food Vendor may request payment be applied to future Organizer event Food Vendor, minus value of commitments already delivered prior to the Event date. In the case the Event is underway but interrupted or adjourned prior to closing time due to any reasons, no refund will be given.
LICENSE TO USE TRADEMARKS: Food Vendor is authorized to use the Organizer's names “Riverside Pride” or “Riverside LGBTQ+ Pride”, and official logos to promote their involvement in the Event from the time this contract is signed to thirty (30) days after the event. We encourage Food Vendor to use the hashtag #RiversidePride when posting on social media.
Food Vendor hereby grants Organizer permission to use their organization name, logo and contact information in relation to their participation in this event. This includes but is not limited to social media, video, printed materials. If the Food Vendor requires an approval process for logo use, it is the responsibility of the Food Vendor to inform the Organizer of such process. If an approval process is required, Food Vendor agrees to a reasonable turnaround time so as not to impede Organizer's ability to promote and execute the Event.
RIGHT OF PUBLICITY: During the Event, Food Vendor and its representatives give Organizer or its designees permission to use their voice, image, or likeness as it appears in any photographic, audio, or video recording in any manner and in all media in perpetuity.
Any Food Vendor that fails to comply with any of the terms and conditions herein may be subject to: (1) early termination of this license to occupy and expulsion from the Event without refund; and/or (2) exclusion from participation in future events with Organizer.
By submitting this Application, checking the box and signing below, the Food Vendor hereby confirms that the information provided in the Application is, to the best of their knowledge, true and correct and further certifies that Food Vendor has read all of the terms and conditions in above and agree to comply with them.
